“The tool essentially exempts Hyde Park from the new proposed development regulations, known as CodeNEXT. Under the NCCD, large single-family homes can be built more easily, he says, where duplexes and other multifamily developments face tougher lot-size restrictions. These “missing middle” homes are prescribed under CodeNEXT.”

While Imagine Austin says to “respect” neighborhood plans, it also was a plan with a high level of scrutiny, and it called for revising the land development code to promote a compact and connected city, not to keep things the same. That is its mandate for CodeNEXT, and the current draft code and maps largely ignore that mandate.

No “direction from council” is needed. State law and the city charter require all land use regulations to support the comprehensive plan.
